Zákon o hospodaření energií prochází od ledna 2026 zásadní transformací. Novela Lex OZE III výrazně rozšiřuje okruh podniků i veřejných institucí, které musí povinně provádět energetické audity nebo zavést systém ISO 50001. Pro dotčené subjekty to znamená nutnost včasné přípravy, jinak riskují pokuty, které mohou vyšplhat až k hranici 5 milionů korun.
Novela zákona č. 458/2000 Sb. (tzv. Lex OZE III) a související úprava zákona č. 406/2000 Sb. o hospodaření energií přináší od 1. ledna 2026 nové povinnosti v oblasti energetického managementu.
Energetický audit
Povinnost provádět energetický audit každé 4 roky vzniká firmám s roční konečnou spotřebou 2 778 MWh až 23 611 MWh. Audit se vztahuje na celé IČO, tedy na součet všech odběrných míst a provozů. Platnost již provedených auditů zůstává zachována, ale nové musí být dokončeny do konce roku 2026.
Audit je povinný, pokud podnik splňuje alespoň jednu z následujících podmínek:
- technologicky složitá výroba
- síť poboček nebo areál s více než 5 budovami
- 10 a více nákladních vozů v provozu
- roční náklady na energie přes 5 mil. Kč
- 70 a více osobních aut
- 500 a více ha zemědělské půdy
ISO 50001
Certifikovaný systém řízení energií podle normy ISO 50001 musí zavést podniky s roční spotřebou nad 23 611 MWh. Na implementaci mají 2 roky od vzniku povinnosti. Týká se zejména velkých organizací s náklady na energie přes 50 mil. Kč ročně, více než 79 nákladními vozidly, 799 osobními automobily, podlahovou plochou nad 120 000 m² nebo 1 000 ha zemědělské půdy.
Veřejný sektor
Nově se povinnost vztahuje i na obce, školy a kraje s roční spotřebou nad 500 MWh. Menší instituce budou audit provádět každých 10 let, větší každé 4 roky, a největší subjekty přecházejí na ISO 50001. Novela má za cíl zvýšit energetickou efektivitu a transparentnost spotřeby. Firmy i veřejné instituce by měly včas vyhodnotit svou průměrnou spotřebu za poslední 3 roky a připravit se na nové povinnosti, aby se vyhnuly sankcím až do 5 milionů korun.
